General Terms and Conditions of Use
This section sets forth the terms and conditions (hereinafter, the “General Terms and Conditions”) for the use of the content and services (hereinafter, the “Services”) on the website www.domtiz.com (hereinafter, the “Website”), operated by Domingo Li Rios (CUIT 23-93245171-9), with its registered address at Olazabal 1515, Office A901, Autonomous City of Buenos Aires.
Please read these General Terms and Conditions before using the Website and/or contracting the Services. If you do not agree with these General Terms and Conditions, please do not continue to use the Website, and do not use or contract the Services offered. By using the Website, the user is deemed to have fully and unreservedly accepted the General Terms and Conditions set forth herein.
For the purposes of this document, the terms “You” and “User” refer to any individual and/or legal entity that accesses the Website for any reason.
1. ACCESS TO THE WEBSITE
1.1. Access to the Website
Access to and use of the Website do not require prior subscription or registration by the user. However, the use and/or procurement of certain Services offered through the Website may require prior subscription or registration by the user and/or the payment of a fee.
1.2. Use of the Website
1.2.1. The User unconditionally agrees to use the Website in accordance with these General Terms and Conditions, applicable laws, and standards of morality and good conduct.
1.2.2. The User agrees to refrain from using the Website for any illicit, illegal, or criminal purposes or effects; for any purposes contrary to these General Terms and Conditions or Argentine law; in a manner that infringes upon the rights and interests of third parties (including DOMTIZ clients and other Website users); or in any way that might alter, modify, damage, disable, overload, or impair (in whole or in part) the Website, or otherwise hinder the normal and proper use of the Website by other users.
1.3. Website Content
1.3.1. The content of this Website—including text, information, graphics, images, logos, trademarks, formatting, computer programs, databases, designs, functional architecture, and any other material displayed on or forming part of the Website (hereinafter, the “Content”)—is protected by applicable laws, including, but not limited to, laws governing copyright, patents, trademarks, utility models, industrial designs, and domain names, as well as relevant international treaties.
1.3.2. All Content is the exclusive property of DOMTIZ and/or its respective owners. Unauthorized use, adaptation, reproduction, and/or commercialization of the Content is prohibited and may be subject to penalties under applicable law.
1.3.3. You may not copy, adapt, or modify the programming code (source and object code) of the programs developed by or on behalf of DOMTIZ, nor any other software used on the Website, for any reason or purpose—specifically including the generation or operation of your own web pages. Such code is protected by the terms of these General Conditions and applicable law.
1.3.4. Through the Website, DOMTIZ offers various services, for which it may apply different pricing based on the specific characteristics of each service. These prices are determined using various criteria, including—but not limited to—the location (zone/neighborhood) of the property featured in a listing, as well as the specific listing packages that DOMTIZ offers (or may offer in the future) to its potential advertisers and/or Users. The specific terms and conditions for the provision of each Service, along with their respective pricing, shall be those published by DOMTIZ on the Website from time to time.
1.4. Permitted Use of the Website
1.4.1. Users may use the Website only in accordance with these General Terms and Conditions. The Website may only be used for lawful purposes, to access information regarding the Services available through it.
1.5. Prohibited Uses
1.5.1. General Rules: Users are prohibited from using the Website (i) in a manner that attempts to breach, breaches, or violates applicable law; (ii) in a manner that infringes upon the rights of third parties or violates the confidentiality, reputation, privacy, image, or other rights of third parties, including DOMTIZ clients; and/or (iii) to send communications without the express authorization of the data owner—including any type of communication, promotions, and/or advertising for products or services, SPAM, or political propaganda—in accordance with applicable regulations.
1.5.2. Website Security Rules: Users are prohibited from violating or attempting to violate the security of the Website, or from taking any action that could harm the integrity of the Website and/or its normal operation, including, but not limited to: (i) accessing (or attempting to access) data or information not intended for the user, or entering a server or account that the user is not authorized to access; (ii) evaluating or testing the vulnerability of a system or network, or breaching or attempting to breach security or authentication measures; (iii) attempting to disrupt or disrupting (in whole or in part) the provision of the Service to any User, host, or network—including, but not limited to, through attacks of any kind (such as sending viruses to the Website, or via network saturation or denial-of-service attacks) or by any other means intended for such a purpose; (iv) sending unsolicited emails or spam, including promotions and/or advertising for products or services; or (v) forging any TCP/IP packet header, or any part of the header information in any email, discussion forum post, or any other form of communication.
1.5.3. Violations of system or network security constitute serious and fundamental breaches of these General Terms and Conditions, as well as criminal offenses. Such actions may result in civil liability and the automatic termination of the User’s account, among other sanctions. DOMTIZ will investigate any instances of system security breaches or violations; it reserves the right to suspend the User’s account for the duration of the investigation and to refer the matter to the appropriate judicial or administrative authorities for the purpose of prosecuting and penalizing the Users involved in such violations.
1.5.4. Without prejudice to the foregoing, DOMTIZ specifically prohibits any use of the Website for:
- Posting incomplete, false, or inaccurate information.
- Using any mechanism to hinder or attempt to hinder the proper functioning of this Website and/or any activity taking place on the Website.
- Revealing or sharing your password (or that of third parties) with other individuals, or using your password for unauthorized purposes.
- Attempting to access and/or examine DOMTIZ’s databases and/or disclosing such information.
- Using or attempting to use any machine, software, tool, agent, or other mechanism to navigate or search this Website, other than the search tools provided by DOMTIZ on this Website.
- Attempting to decipher, decompile, or obtain the source code of any software program on this Website, and/or reverse-engineering such source code.
1.5.5. DOMTIZ reserves the right to indefinitely suspend or terminate the account associated with any classified ad (whether free or paid), as well as any account or User that, in the sole discretion of DOMTIZ, fails to comply with the terms of these General Conditions or with DOMTIZ’s current policies, as set forth herein; such action shall not entail any obligation on the part of DOMTIZ to provide a refund or any form of compensation.
1.6. Communication channels available to Users
1.6.1. Users may utilize the available communication channels—such as chats and discussion forums, among others—(hereinafter, the “Channels”). Should a User voluntarily choose to use them, they must do so in a responsible, respectful, and proper manner, in full compliance with applicable regulations.
1.6.2. The content of any message sent by a User through the Channels is the sole and exclusive responsibility of that User. DOMTIZ does not guarantee the veracity or accuracy of any personal data and/or content contained in messages sent or posted by a User via the Channels. Users voluntarily accept that any access to and/or use of the Channels is, in all cases, at their own sole and exclusive risk and responsibility.
1.6.3. DOMTIZ reserves the right to suspend—temporarily or permanently—access to the Channels and/or the Services, without prior notice, for any individual who fails to comply with these General Terms and Conditions, or who engages in actions that interfere with the normal operation of the Services, the Channels, or the Website, or that otherwise cause harm to them.
1.6.4. Users acknowledge and agree that the following behaviors are strictly prohibited—both within the Channels and anywhere else on the Website—and therefore irrevocably commit to refraining from engaging in them:
(a) Using vulgar/obscene, discriminatory, and/or offensive language;
(b) Any form of personal attack against Users and/or third parties, including DOMTIZ clients, through harassment, threats, insults, and/or any type of aggression;
(c) Any act contrary to the law, morality, or accepted standards of conduct;
(d) Posting notices, messages, images, or hyperlinks that are offensive, defamatory, libelous, slanderous, false, discriminatory, pornographic, violent, insulting, threatening, or that incite illicit behavior or conduct dangerous to health; content that harms the reputation and/or violates the privacy of any third party; as well as the direct or indirect infringement of the intellectual property rights of DOMTIZ and/or any third party, including DOMTIZ clients;
(e) Posting notices and/or messages that may offend or affect the sensibilities of other Users and/or any third party, including—but not limited to—clients and/or Users of the DOMTIZ Group;
(f) Promoting, marketing, selling, posting, and/or offering any type of products, services, and/or activities through the use of the Channels, except for those expressly permitted by DOMTIZ;
(g) The sale, leasing, or transfer—whether for a fee or free of charge—of communication space within the Channels;
(h) Posting notices or messages that contain any form of advertising;
(i) The use or transmission of computer viruses, malware, spyware, or ransomware, and/or the performance of any act that causes—or could cause—damage or harm to the normal operation of the Services and/or the Channels, or to the computer equipment or software of DOMTIZ and/or any third party, including DOMTIZ clients;
(j) Any act intended to mask, falsify, or conceal IP addresses, email addresses, and/or any other technical means used to identify Users or their computing equipment;
(k) Any act that violates the privacy of other Users, or that infringes upon any of their rights under applicable law.
(l) The publication of personal data without the express consent of the data subject or of DOMTIZ.
(m) The transmission or dissemination of material that violates the legislation in force in the country and/or that could offend other Users and/or any third party, including clients of DOMTIZ;
(n) The publication of any type of content that infringes upon the rights of third parties (including clients of DOMTIZ), including, without limitation, intellectual and/or industrial property rights.
(o) The posting of classified ads (whether free or paid) for the lease, sale, or purchase of real estate for illicit, illegal, or criminal purposes, or for purposes that are contrary to the provisions of the General Terms and Conditions, applicable law, or that are harmful to the rights and interests of third parties.
1.6.5. DOMTIZ is under no obligation to monitor—and does not monitor—how the User utilizes the Channels, the content of posts made therein, or the content of advertisements published on the Website. Nevertheless, DOMTIZ reserves the right to decline to publish, or to remove after publication, any advertisements, content, and/or messages proposed or posted by the User that, in DOMTIZ’s sole discretion, do not strictly adhere to the provisions set forth in these General Conditions, are deemed inappropriate or unsuitable given the nature, purpose, or quality of the Services, or otherwise violate these General Conditions.
1.6.6. DOMTIZ does not guarantee the availability or continuous operation of the Channels and shall, under no circumstances, be held liable for the destruction, alteration, modification, or deletion of any content or information that a User includes in messages posted on the Channels.
1.6.7. Each User bears sole and exclusive responsibility for their own statements, remarks, opinions, and any actions taken through the Channels, as well as for any classified advertisements they post on the Website.
1.6.8. DOMTIZ reserves the right to indefinitely suspend, exclude, or prohibit a User from using the Channels or accessing the Website, and/or to terminate any account, advertisement, or User that, in DOMTIZ’s sole discretion, fails to meet the standards defined in these General Conditions, the General Terms and Conditions of Service, or DOMTIZ’s current policies. Such action shall not give rise to any obligation on the part of DOMTIZ to provide refunds or compensation, nor shall it entail any liability for DOMTIZ.
1.7 LEVEL
1.7.1. DOMTIZ will implement an automated rating system for advertisers based on the following metrics (the “Level”): (i) the overall rating given to the advertiser by Website Users who have interacted with the advertiser; (ii) the advertiser’s response rate to inquiries made by Website Users; (iii) the completeness of the advertiser’s listing; and (iv) the length of time the advertiser has been on the Website. This automated system relies on an algorithm designed to provide an objective rating—assigned without human intervention—and operates according to principles of transparency and fairness. The assigned rating is the result of a calculation based on data provided by users and the advertiser’s activity on the platform.
1.7.2. The Level will result in an overall rating for each advertiser, expressed on a scale of 1 to 5. A color-coded system (similar to a traffic light) may also be used to provide feedback on performance and areas for improvement. Note that if an advertiser receives a rating of 1 or 2, that rating will not be visible to Website Users.
1.7.3. The Level does not constitute a comprehensive assessment of the quality of service provided by the advertiser, nor does it represent an opinion or evaluation of the advertiser by DOMTIZ. This rating is provided solely for reference and informational purposes for Website Users and should not be interpreted as a recommendation, guarantee, or endorsement by the platform.
1.7.4. By creating an account to access the Website, advertisers fully accept the evaluation system and the publication of their Level. Furthermore, they acknowledge and accept that said system may be modified, updated, or discontinued by DOMTIZ at any time, without giving rise to any right to compensation.
1.7.5. Advertisers shall have the right to request a review, clarification, or correction of their Level should they detect errors or inconsistencies in the evaluation; for this purpose, DOMTIZ will provide a contact channel and a review procedure.
1.7.6. Users and/or advertisers accept that DOMTIZ shall bear no responsibility whatsoever for the ratings obtained within the evaluation system, given that the Level is automated, objective, and based exclusively on metrics—without implying any assessment, judgment of merit, or disparagement on the part of DOMTIZ.
1.7.7. Users and/or advertisers unconditionally and irrevocably release DOMTIZ from any liability regarding the "Level," given that it is based on objective criteria rather than value judgments made by the company. Users and/or advertisers agree and declare that they waive any right to file claims or initiate legal action related to the assigned rating, and that they shall not seek from DOMTIZ any compensation, penalties, sanctions, damages, losses, or liability (including for any reputational, moral, or other type of harm) that the user and/or advertiser might incur as a result of the determination and publication of the Level. This waiver of liability shall remain in effect even if the evaluation system is adjusted, suspended, or discontinued.
2. USER PERSONAL DATA. REGISTRATION ON THE WEBSITE
DOMTIZ values your privacy, and we protect your personal data in accordance with Law No. 25.326 on the Protection of Personal Data and its supplementary regulations. Please visit the DOMTIZ Privacy Policy to learn how we collect, use, and protect your data.
3. MINORS
3.1. The use of the Website and/or the Services offered through it by individuals who lack the legal capacity to enter into contracts, or by minors under Argentine law, is prohibited. In such cases, minors or individuals lacking legal capacity must first obtain express, written permission from their parents, guardians, or legal representatives, who shall be held responsible for all actions taken by the individuals under their care.
3.2. The Website is an evolving community that includes various Users with diverse experiences and backgrounds. Although DOMTIZ makes its best efforts to monitor and, where necessary, take action against potential inappropriate conduct by other Users or third parties, it is impossible to entirely prevent behavior that violates these General Terms and Conditions. Consequently, it is possible that, while accessing the Website or using any of the Services offered—including chat rooms and public forums—users may encounter language or other materials that could be considered inappropriate for minors or offensive to other Users. While these General Terms and Conditions establish codes of conduct for users, DOMTIZ cannot guarantee that all users will comply with them. Therefore, it is the responsibility of Users to report any irregular activity or conduct that violates these Specific Terms and Conditions through the channels provided by DOMTIZ for such purposes.
3.3. By accessing the Website and using the Services, the User declares, warrants, and confirms that they are of legal age and/or fully capable of using the Website in accordance with these General Terms and Conditions.
4. USER RESPONSIBILITY
The User declares and unconditionally accepts that the use of the Website, its Services, and its content is undertaken voluntarily and at the User’s sole and exclusive responsibility and commercial risk. Should a User encounter a listing that, in their sole discretion, appears misleading, fraudulent, incomplete, false, and/or inaccurate, the User is obligated to report it to DOMTIZ using one of the reporting tools implemented by DOMTIZ as a sound business practice, with the aim of ensuring high-quality content on the Website.
(a) Customer Service Telephone Line: This tool consists of a telephone number managed by our customer service department. The User should call 1169115968 and must explicitly reference the identification number (“ID”) of the listing in question.
(b) Customer Service Email: This tool consists of an email address managed by our customer service department. The User should send an email to contacto@domtiz.com, providing details regarding the issue with the listing in question. The User must explicitly reference the ID number of the listing in question.
5. EXCLUSION OF WARRANTIES AND LIABILITY
5.1. Given the current state of technology and the structure and operation of networks, the Website cannot confirm that each User is who they claim to be, nor is it under any obligation to do so.
5.2. DOMTIZ does not guarantee the availability or continuous, error-free operation of the Website and the Services offered. Not all Services and content are available in every geographic area. Furthermore, DOMTIZ does not guarantee that the Website and the Services will function without errors for any specific activity, nor does it guarantee their infallibility—specifically, though not exclusively, it does not guarantee that Users will be able to successfully use the Website or access the various web pages that comprise the Website or those through which the Services are provided.
5.3. DOMTIZ does not guarantee that the Website will operate without errors, or that the Website and its server are free from computer viruses, other harmful mechanisms, or malware, as the obligation in question is an "obligation of means" (an undertaking to exercise due care rather than a guarantee of a specific result).
5.4. The Website and the Services are provided "as is," without warranties of any kind.
5.5. DOMTIZ does not guarantee the accuracy, veracity, completeness, or currency of the content, Services, software, text, graphics, or links.
5.6. Under no circumstances shall DOMTIZ be liable for any damages—including, but not limited to, direct and/or indirect damages, loss of profits, or loss of opportunity—arising from the use or the inability to use the Website.
5.7. DOMTIZ shall not be held liable for any damages of any nature caused by third parties who are not affiliated with or authorized by DOMTIZ, whether regarding the Personal Data of Users or the Services offered on the Website.
5.8. Regarding certain listings published on the Website, you may use our platform to contact the User who posted the listing and exchange messages containing comments, opinions, inquiries, pricing, and/or potential terms and conditions that might eventually lead to an offer. In this regard, you expressly acknowledge and declare that such messages do not constitute an offer, an invitation to treat (an invitation to make an offer), or a contract of any kind; rather, they serve merely as a preliminary point of contact between you and the author of the listing on the Website—a process in which DOMTIZ does not intervene and is not, nor will it become, a party. Consequently, any exchange or communication conducted through the Website with a User shall not create any obligation for DOMTIZ, nor shall it grant you any right to bring a claim against DOMTIZ. Therefore, DOMTIZ shall not be held liable for any issues, breaches, or conflicts—of any nature—that may arise in connection with any potential transaction or contract entered into between Users of the Website.
5.9. By using the Website, you expressly acknowledge and unconditionally accept that DOMTIZ merely provides a communication space for individuals to connect. As such, DOMTIZ is a third party entirely uninvolved in the communications, exchanges, transactions, or operations that may take place between you and the author of a listing on the Website. Furthermore, any information, suggestions, or advice appearing on the Website are intended solely as general guidance for informational and supportive purposes; they do not, under any circumstances, replace professional advice regarding personal, medical, legal, tax, accounting, financial, or any other matters. You should consult with an appropriate professional to obtain information tailored to your specific personal situation.
5.10. DOMTIZ is in no way responsible for any misuse of the Website by advertising Users through the publication of classified ads that are—or prove to be—misleading, fraudulent, incomplete, false, and/or inaccurate.
5.11. Any User who utilizes the Website and engages the Services does so at their own risk. Under no circumstances does DOMTIZ guarantee: (i) that advertising Users are who they claim to be; (ii) the nature of any rights or legal interests that advertising Users may—or may not—hold regarding the advertised properties; or (iii) the accuracy of the sale or rental prices for properties advertised on our platform. Furthermore, DOMTIZ assumes no obligation to verify such information.
5.12. DOMTIZ, its directors, employees, shareholders, or advisors do not draft—nor are they responsible for—the content of advertisements published by advertising Users.
5.13. DOMTIZ expressly disclaims any warranties of merchantability, satisfactory quality, fitness for a particular purpose, quiet enjoyment, or non-infringement, as well as any other express or implied warranties.
6. LINKS TO OTHER SITES
The Website contains links to other Internet sites. DOMTIZ is not the author or owner of, nor does it endorse, the content of these websites, which are managed by their respective owners and hosts. DOMTIZ is not responsible for the content of third-party websites, nor for any services or products offered or provided by such third parties, and makes no representations regarding the content or accuracy of these third-party websites. If you choose to access linked third-party websites, you do so at your own risk and responsibility.
7. ASSIGNMENT OR UNAUTHORIZED COMMERCIAL USE
7.1. The User agrees not to assign, under any circumstances, their rights or obligations under these General Terms and Conditions, and agrees not to make any unauthorized commercial use of the Website. For its part, DOMTIZ may assign these General Terms and Conditions without the need for notification to or authorization from the Applicant.
7.2. In accordance with these General Terms and Conditions, the User undertakes to use the Website and the Services diligently, in compliance with applicable law and these General Terms and Conditions.
8. CANCELLATION
8.1. DOMTIZ has the authority—though not the obligation—to issue warnings, impose temporary suspensions (for an indefinite period), or permanently cancel (terminate) the accounts of registered Users for violations of these General Terms and Conditions, and/or any notices, usage rules, or instructions brought to the User’s attention by DOMTIZ.
8.2. Without prejudice to the foregoing, DOMTIZ reserves the right, at its sole discretion, to employ all legal means at its disposal to ensure compliance with these General Terms and Conditions and, where applicable, to sanction any User who violates any of these General Terms and Conditions.
8.3. Users may cancel the Services they have contracted at any time and at their own discretion, provided they give prior notice to DOMTIZ. Notwithstanding this, Users shall not be entitled to any refund for the Services contracted.
9. INDEMNIFICATION
You agree to indemnify and hold harmless DOMTIZ and its owners from and against any charges, actions, demands, and/or claims of any nature—including, but not limited to, reasonable legal fees and costs—arising from your use of the Website, the Content, or the Services in a manner that is unlawful or contrary to these General Terms and Conditions. You acknowledge and agree that DOMTIZ acts solely as an intermediary and is not a party to any relationship that may be established between you and those who post notices, advertisements, and/or proposals through the Website. Accordingly, you agree not to hold DOMTIZ liable for any consequences arising from such relationships.
10. GENERAL
10.1. DOMTIZ reserves the right to modify these General Terms and Conditions, in whole or in part, at any time. In such cases, the updated General Terms and Conditions will be published on the Website; they will apply automatically and supersede any previous versions. It is the Users' responsibility to check this section regularly to stay informed of any changes that may have occurred. The User agrees that the publication of the updated General Terms and Conditions by DOMTIZ shall be considered valid and sufficient notification. Furthermore, if the User continues to use the Services and/or the Website, they shall be deemed to have implicitly accepted the new General Terms and Conditions. Without prejudice to the foregoing, DOMTIZ may—though it is under no obligation to do so—notify the User of the updated General Terms and Conditions via the email address registered for use on the Website, or by providing notice on the Website itself.
10.2. Should any clause within these General Terms and Conditions be declared null and void, such invalidity shall not affect the validity of the remaining clauses, which shall continue to remain in full force and effect.
10.3. The Privacy Policy and the General Terms and Conditions for Contracting via the Website—both of which may be viewed on the Website—form an integral part of these General Terms and Conditions. These General Terms and Conditions, together with the Privacy Policy, the General Terms and Conditions for Contracting via the Website, and any specific terms applicable to individual Services, constitute the entire agreement between the Applicant and DOMTIZ.
11. DURATION AND TERMINATION
The provision of the Website Service is for an indefinite duration. Notwithstanding the foregoing, DOMTIZ is authorized to terminate or suspend the provision of the Website Service and/or any of its Content at any time.
12. LOCATION
12.1. ARGENTINA
These General Terms and Conditions are governed by the laws of the Argentine Republic. The User submits to the jurisdiction of the ordinary courts of the Autonomous City of Buenos Aires and/or any other jurisdiction that may apply in accordance with the applicable regulations.
